This website is operated by Rachel Stevens Photography. Throughout the site, the terms “we”, “us”, “our” and “Rachel Stevens Photography” refer to Rachel Stevens Photography.

Rachel Stevens Photography provides fine art photography prints, framed and unframed prints, canvas artworks, limited edition photographic artworks, photographic products, gifts and related products through this website.

By visiting our website and/or purchasing something from us, you agree to be bound by these Terms of Service (“Terms”), together with any other policies or terms referred to on this website, including our Privacy Policy and Refund & Returns Policy.

These Terms apply to all users of the website, including browsers, customers and anyone who accesses or uses the website.

Please read these Terms carefully before using our website or placing an order. If you do not agree with these Terms, you should not use our website.

Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies you may have under New Zealand law, including the Consumer Guarantees Act 1993 or Fair Trading Act 1986, where those laws apply.

Our store is hosted on Shopify, which provides the e-commerce platform that enables us to sell our products and services online.


SECTION 1 — ONLINE STORE TERMS

By using this website, you confirm that you are legally capable of entering into a contract under New Zealand law.

You must not use our products or website for any unlawful or unauthorised purpose, including in a way that infringes copyright, trade marks or other intellectual property rights.

You must not transmit or introduce any worms, viruses, malware or other code of a destructive or harmful nature.

We reserve the right to refuse or cancel an order where we reasonably believe that these Terms have been breached, an order has been placed fraudulently, or the website is being used unlawfully.


SECTION 2 — GENERAL CONDITIONS

We reserve the right to refuse service or cancel an order where permitted by law.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of our website, products, photography, written content or other intellectual property without our prior written permission.

The headings used in these Terms are for convenience only and do not affect the interpretation of the Terms.


SECTION 3 — OUR PHOTOGRAPHY AND INTELLECTUAL PROPERTY

All photographs, images, artwork, videos, graphics, logos, written content, product descriptions, website content and other original material displayed on this website are owned by or licensed to Rachel Stevens Photography unless otherwise stated.

Our photographs are protected by copyright under New Zealand law.

Purchasing a print, canvas, acrylic artwork, ChromaLuxe artwork or other physical product does not transfer copyright or reproduction rights to you.

When you purchase an artwork, you are purchasing the physical artwork only. You do not acquire the right to:

  • reproduce, scan, copy or photograph the artwork for commercial reproduction;

  • reproduce the photograph on merchandise;

  • sell or distribute copies of the photograph;

  • use the photograph in advertising or promotional material;

  • upload or distribute a high-resolution copy of the photograph;

  • reproduce the photograph in digital or printed form; or

  • otherwise exploit the photograph commercially,

unless you have received express written permission from Rachel Stevens Photography.

Personal photographs of your purchased artwork for your own non-commercial use are permitted, provided they are not used to create reproductions or commercial products.

Copyright remains with the copyright owner at all times.

New Zealand's Intellectual Property Office confirms that copyright protection generally arises automatically when an original work is created, and permission is generally required where someone wishes to use a copyright work in a way reserved to the copyright owner.


SECTION 4 — PRODUCT IMAGES, COLOUR AND DISPLAY

We make every reasonable effort to display our products, photographs and colours as accurately as possible.

However, colours may appear differently depending on your monitor, screen, browser, device settings and lighting conditions.

Fine art photographic prints may also have subtle differences in colour, tone, contrast and appearance depending on the printing process, paper, canvas, acrylic, metal or other substrate used.

These variations are not necessarily defects.

Where a product is a photographic artwork, the final physical artwork may not appear identical to the image displayed on your screen.

Product photographs may also be representative images. Frames, mounts, hanging systems and other presentation elements may vary slightly from images shown on the website where necessary to accommodate availability or production requirements.

We will, however, ensure that products supplied to you comply with their description and your rights under applicable New Zealand consumer law.


SECTION 5 — PRODUCTS AND AVAILABILITY

Certain products are available exclusively through our website.

Some products, including limited edition artworks, may be available in limited quantities.

We reserve the right to:

  • discontinue products;

  • change product specifications;

  • change prices;

  • change available sizes, finishes or framing options; and

  • limit quantities where reasonably necessary.

Any changes will not affect an order that we have already accepted except where required by law or where an error has occurred.

We make reasonable efforts to ensure product descriptions, dimensions, availability and pricing are accurate. However, errors or omissions may occasionally occur.

If we identify a significant error in the price or description of a product after you have placed an order but before the order has been dispatched, we may contact you to confirm whether you wish to proceed with the corrected information. If you do not wish to proceed, we will provide an appropriate remedy, including a refund where applicable.


SECTION 6 — ORDERS AND ACCEPTANCE

When you place an order through our website, you are making an offer to purchase the products selected by you.

You will receive an order confirmation after placing your order. An order confirmation acknowledges that we have received your order but does not necessarily constitute acceptance of the order.

We reserve the right to decline or cancel an order where permitted by law, including where:

  • a product is unavailable;

  • there has been an obvious pricing or description error;

  • we suspect fraudulent or unauthorised activity;

  • there is an error in the order;

  • we are unable to fulfil the order; or

  • circumstances outside our reasonable control prevent fulfilment.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order.


SECTION 7 — PRICES AND PAYMENT

All prices displayed on our website are in New Zealand dollars (NZD) unless otherwise stated.

Prices include GST where applicable.

Prices may change from time to time. Any price change will not affect an order that we have already accepted, except where an obvious pricing error has occurred.

Payment must be successfully received before an order is processed unless otherwise agreed.

We use third-party payment providers to process payments. We do not generally have access to or store your complete payment card details.

You agree to provide accurate and complete billing and contact information when placing an order.


SECTION 8 — CUSTOM, MADE-TO-ORDER AND FRAMED PRODUCTS

Some products are made to order or customised according to the options selected when you place your order.

This may include, but is not limited to:

  • framed prints;

  • framed canvas;

  • selected print sizes;

  • selected framing colours;

  • limited edition artworks;

  • custom presentation options; and

  • other products manufactured specifically following your order.

Because these products may be made specifically for you, they may not be eligible for cancellation or return simply because you have changed your mind, subject always to your rights under the Consumer Guarantees Act and other applicable New Zealand law.

If a made-to-order product is faulty, damaged, incorrectly supplied or otherwise fails to comply with applicable consumer guarantees, please contact us so that we can assess the issue and provide an appropriate remedy.


SECTION 9 — SHIPPING AND DELIVERY

We will provide estimated delivery or production timeframes where reasonably possible.

Delivery timeframes are estimates only unless we have expressly agreed otherwise.

Once your order has been dispatched, delivery is handled by the relevant courier or delivery provider.

We are not responsible for delays caused by circumstances outside our reasonable control, including courier delays, severe weather, natural disasters, strikes, transport disruptions or other events beyond our reasonable control.

We remain responsible for meeting our obligations under applicable New Zealand consumer law, including obligations relating to delivery.

If your order arrives damaged, please contact us as soon as reasonably possible and provide photographs of the packaging and damaged product where possible. This helps us investigate the issue with the courier or production partner and determine the appropriate remedy.


SECTION 10 — RETURNS, REFUNDS AND FAULTY PRODUCTS

Our returns and refund procedures are set out in our Refund & Returns Policy.

Nothing in our Refund & Returns Policy or these Terms limits your rights under the New Zealand Consumer Guarantees Act 1993 or other applicable law.

If a product is faulty, damaged, does not match its description, or otherwise fails to meet the guarantees required by law, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances.

The Consumer Guarantees Act provides minimum guarantees for products sold by businesses in New Zealand, including guarantees relating to acceptable quality, fitness for purpose and matching the description.

A change of mind does not automatically create a right to a refund where the product is otherwise satisfactory and the law does not provide such a right.

Where you believe there is a problem with your order, please contact us promptly so we can investigate and work with you to resolve the issue.


SECTION 11 — LIMITED EDITION ARTWORKS

Where an artwork is described as a limited edition, the edition size stated on the product page represents the maximum number of that particular edition intended to be produced.

Each limited edition artwork may be individually numbered where applicable.

Limited edition numbering is part of the artwork's presentation and does not transfer copyright or reproduction rights to the purchaser.

Once a limited edition is sold out, we will not intentionally produce additional artworks beyond the stated edition size, except where required to replace a defective or damaged artwork within the applicable edition and where reasonably necessary.


SECTION 12 — ACCURACY OF INFORMATION

We make reasonable efforts to ensure that information on this website is accurate and current.

However, the website may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, availability or other information.

We reserve the right to correct such errors or omissions.

We do not guarantee that all information on the website will always be complete, accurate or current.

Nothing in this section limits any rights you have under New Zealand consumer law.

We reserve the right to remove or decline to publish content that we consider inappropriate, misleading, offensive or otherwise unsuitable.

We do not guarantee that the website will always be available, uninterrupted, secure or error-free.

We are not responsible for delays or failures caused by events outside our reasonable control.

Nothing in these Terms excludes, restricts or modifies any liability, guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under New Zealand law.

Where such an event affects your order, we will take reasonable steps to notify you and minimise the impact where possible.
